
6 General Issues
6.1 Protection of local ridgelines
We note that the Working Draft LEP provides some protection of Burra's ridgelines from development. This is achieved by zoning some of the ridge tops as E3 Environmental Management where electricity generation including industrial wind turbines is not permitted. These include part of the Molonglo ridge, some land between the Googong Foreshore and the Tinderry Nature Reserve and the ridges between Burra and Royalla. Given these zonings, there may also be a case for applying the E3 Environmental Management Zone to the very steep and fragile ridge-lines between the Googong Foreshores and the Burra Road north of London Bridge Road .
The Working Draft LEP also attempts to restrict the visual impact of development as follows:
Clause 6.17 (2) states that consent must not be granted to the carrying out of development involving works or building construction within zones R5, RU1, RU2, E2, E3 and E4 unless the consent authority is satisfied that the development:
- is not likely to detract from the visual amenity of the local area; or
- is of significant benefit to the broader community.
Clause 6.17 ((3) (d) states that in determining whether to grant consent the authority must consider the following:
(d) whether the buildings are sited below ridgelines so that:
- no part of the structure protrudes above the ridgeline if the site is visible from a public place; and
- vegetation clearing associated with the development does not impact on the existing vegetation form and line.
6.2 Potential to re-zone Land in the Vicinity of the Burra Park .
Under the working Draft LEP, Council-owned land in the Burra Park area is zoned E4 Environmental Living. There may be an opportunity for this land to be re-zoned to allow for mixed use, such as the B1 Neighbourhood Centre Zone.
